Proskauer recently represented the Institute for Innovation in Prosecution at John Jay College in submitting an amicus brief before the Supreme Court of North Carolina in a major voting rights lawsuit. The case, Community Success Initiative v. Moore, involves a challenge to N.C. Gen. Stat. §13-1, a felony supervision law that denies the franchise to over 56,000 North Carolinians. Under §13-1, individuals who have been convicted of felonies cannot register to vote unless they have been “unconditionally discharged” from felony probation, parole, or post-release supervision.

To grow up American in all ways but one – having proper documentation – is what it means to be a dreamer. Being undocumented renders one nearly incapable of functioning as a regular member of society. It means calling in sick during the day of a school field trip that asks you to bring a form of government ID. It means being unable to get a job to fund and pursue higher education. It means being ineligible for most healthcare benefits during a pandemic.

Last week, in partnership with The Door, we hosted a virtual Deferred Action for Childhood Arrivals (DACA) clinic to assist 10 pro bono clients with preparing their initial DACA applications. The DACA program provides eligible, undocumented immigrants who came to the United States before the age of 16 with a renewable two-year period of deferred action from deportation, along with work authorization and the ability to apply for a social security number.

Pervasive anti-LGBTQ violence around the world causes many individuals to flee their countries of origin in search of safety. The past few years have been tremendously difficult for immigrants of all walks of life, but especially so for LGBTQ and HIV-affected asylum applicants who have fled to the United States

In the United States, people of limited means suffer a tremendous unmet need for legal services in civil proceedings. Why does the United States fall so far behind in providing that service in comparison with other western democracies?

Background on the Right to Counsel

In 1963, the Supreme Court decided Gideon v. Wainwright, the landmark Sixth Amendment decision requiring that states provide legal counsel for indigent criminal defendants. No such right to counsel, however, has been established in civil proceedings despite the fact that for many low-income individuals, the outcome of certain civil legal proceedings can have an impact as significant, lasting, and life-altering as some criminal cases.

In the absence of a federally recognized right to counsel in civil matters, state and local authorities have been primarily responsible for protecting the rights of low-income individuals in civil proceedings where they see fit.  As a result, the provision of free legal services differs greatly from state to state, and even within a given state.

A 2017 study demonstrated that 71% of low-income households experienced at least one civil legal problem that year, including health care, housing conditions, veterans’ benefits, disability access, and domestic violence matters. In 86% of those civil legal problems, low-income Americans “received inadequate or no legal help.” In addition, in over three-fourths of all civil trials in the United States, at least one litigant does not have legal representation.

Earlier this month, Proskauer filed an amicus brief on behalf of the Brady Center to Prevent Gun Violence in support of the Commonwealth of Massachusetts’ ban on assault weapons, such as the AK-47 or the AR-15, and large-capacity magazines.  We filed the brief with the United States Court of Appeals for the First Circuit in Worman v. Healey, a case challenging the ban on Second Amendment grounds.  Partner Kimberly Mottley and I led the team, with Lindsey Olson Collins and Steven A. Sutro co-authoring the brief.

Since 1998, Massachusetts has banned the sale and possession within the state of military-style assault weapons and large capacity magazines.  These same weapons were used in some of America’s deadliest mass shootings:  Sandy Hook Elementary in Newtown, Connecticut;  the Pulse nightclub in Orlando, Florida;  the Route 91 Harvest Festival in Las Vegas, Nevada;  Marjory Stoneman Douglas High School in Parkland, Florida; and most recently,  the Temple of Life synagogue in Pittsburgh, Pennsylvania. The popularity of such assault weapons among perpetrators led the New York Times to dub them the “rifles of choice for mass shootings.”

Recent events have created an urgent need for an independent Immigration Court separate from the Department of Justice.  On October 17, Proskauer hosted a panel discussion in its New York office co-sponsored by Sanctuary for Families, the New York Immigration Coalition, and the Federal Bar Association’s Immigration Law Section entitled, “Lives in the Balance: Eviscerating Asylum Protection for Victims of Gender Violence.”  The speakers included The Hon. Carolyn Maloney, U.S. Representative from New York’s 12th Congressional District, the Hon. Amiena Khan, Executive Vice President, National Association of Immigration Judges, Lori Adams, Director, Immigration Intervention Project at Sanctuary for Families, and Lisa Koenig, a Partner at Fragomen.

The immigration lawyers on the panel provided different perspectives on Matter of A-B, a consequential decision from last summer where the Attorney General purported to overrule Immigration Court precedent, and thereby limit the availability of domestic violence as a basis for asylum.  Aside from placing the law on asylum in flux, the AG’s action raises the important question of how a cabinet-level, executive branch official could claim the authority to reverse a court’s decision.
